1. Service Description and Limitations
QAF Wills is an online will drafting service provided by QAF Legal, a UAE law firm. We assist with the preparation, review, and registration of wills through ADGM Courts and DIFC Courts directly, and through our associated firms for mainland (ADJD and Dubai) registrations. We are not a substitute for full estate planning advice. You are encouraged to seek independent legal advice for complex estate matters.
2. Lawyer Review
Every will prepared through QAF Wills is reviewed by a qualified QAF Legal lawyer. The questionnaire is a starting point; our lawyers may contact you for clarification before finalizing your will.
3. Client Representations and Warranties
By submitting a will application through QAF Wills, you represent and warrant that: a) The information provided in your questionnaire is true, accurate, and complete to the best of your knowledge. b) You are of sound mind and acting of your own free will. c) You are 21 years of age or older. d) For ADGM and DIFC wills: you confirm that you are not a Muslim, as ADGM and DIFC wills are available to non-Muslims only. e) You understand that providing false or misleading information may result in your will being invalid.
4. Fees and Payment Terms
All fees are quoted in UAE Dirhams (AED) and include court registration fees. Fees are payable in full before the will drafting process begins. Once payment is confirmed, the will drafting process commences within 1 business day. Fees are non-refundable once the will drafting process has begun, except where QAF Legal has not commenced any work. Court fees are government charges passed through at cost and are non-refundable once submitted to the relevant authority.
5. Refund Policy
If you cancel your application before the will drafting process has begun (before a lawyer has been assigned), you are entitled to a full refund. If you cancel after the drafting process has begun, the fee is non-refundable. If QAF Legal is unable to register your will due to a conflict of interest or other legal impediment identified during review, you will receive a full refund.
6. Revisions
Revision entitlements vary by package. Lifetime revisions to your will document are free of professional charges; court re-filing fees apply when a revised will is re-registered.
7. No Legal Advice Until Engagement
Content on this website is general information, not legal advice. A lawyer-client relationship is established once your application is submitted and accepted by QAF Legal.
8. Privacy and Data Protection
QAF Legal collects and processes your personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data. Your data is encrypted, stored securely, and used solely for the purpose of drafting and registering your will. Your data will not be shared with third parties except: (a) to the extent required for court registration, (b) to our associated firms for mainland registrations, or (c) as required by law.
9. Limitation of Liability
QAF Legal's liability in connection with the QAF Wills service is limited to the fees paid by the client for the specific will application. QAF Legal shall not be liable for indirect, consequential, or punitive damages. QAF Legal is not liable for the outcome of court registration decisions, which are at the sole discretion of the relevant court.
10. Intellectual Property
All will drafts, templates, and supporting materials prepared by QAF Legal remain the intellectual property of QAF Legal until the final will is delivered to the client. The client retains ownership of all personal information and instructions provided.
11. Force Majeure
QAF Legal shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond its reasonable control, including but not limited to government actions, court closures, natural disasters, or pandemics.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Abu Dhabi, United Arab Emirates. Without prejudice to the foregoing, disputes relating to ADGM-registered wills shall fall under the jurisdiction of the ADGM Courts, and disputes relating to DIFC-registered wills shall fall under the jurisdiction of the DIFC Courts, in each case to the extent such courts have jurisdiction over the relevant matter.
13. Amendments to Terms
QAF Legal reserves the right to amend these Terms at any time. Amendments take effect upon publication on this page. Applications submitted before the amendment date are governed by the Terms in effect at the time of submission.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between QAF Legal and the client regarding the QAF Wills service, and supersede all prior communications and agreements, whether written or oral.
